2.00 Joint Use Facilities Debt. 2.01 Joint Use Facilities. "Joint Use Facilities", as used in the Operating Agreement and this Capital Agreement, means those portions of the North Olmsted Sanitary Sewer System which benefit the Service Area, being (i) ttie sanitary sewerage collection facilities within North Olmsted which transport wastewater origi-iating iii the Service Area and (ii) the wastewater treatment plant used to treat such wastewater. 2.02 Joint Use Facilities Debt. North Olmsted's "Joint Use Facili- ties Debt" means: (a) 94.7342% of the aggregate principal amount of the $4,000,000 Sanitary Sewerage System Improvement Bonds, dated October 1, 1985 (the "1985 Bonds"), being ttie only general obligation bonds of North Olmsted issued prior to January 1, 1987, without a vote of its electors, to provide funds to pay costs of constructing improvements to the Joint Use Facilities; and (b) 68.09% of the $2,442,596 OWDA loan under an agreement dated June 30, 1970 (ttie "1970 OWDA Loan"), being the only loan from the Ohio Water llevelopment Authority to North Olmsted ("OWDA") contracted for prior to January 1, 1987 for the purpose of providing funds to pay costs of constructing improvements to the Joint Use Facilities. 3.00 System of Fees and Charges; Operation of the Joint Use Facilities 3.01 General Provisions. In addition to the operation, maintenance, and replacement charges with respect to the Joint Use Facilities and sur- charges f.or treatment of Indust1ial Wastes (as defined in the Operating Agreement), determined in accordance with the provisions of the Operating Agreement, Fairview Park agrees that it shall pay capital charges with respect - 4 -
