<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-30 <br />BY: MR. O'GRADY <br />AN ORDINANCE AMENDING SECTION 549.10 OF THE CODI- <br />FIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED "DISCHARGING FIREARMS", AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, it has been brought to the attention of this Council that the offense of <br />discharging firearms within the City limits is a fourth degree misdemeanor which is punishable <br />by imposing a fine of not more than $250.00 or imprisonment, but not more than thirty (30) <br />days, and <br />WHEREAS, it is the belief of this Council that the discharging of a firearm within the <br />City limits is a serious threat to the health, safety and welfare of the residents of the City and <br />is of such magnitude that the violation of the provisions of the Codified Ordinances dealing <br />with the discharge of firearms ought to be a first degree misdemeanor which is punishable of a <br />fine of not more than One Thousand Dollars ($1,000.00) or imprisonment of not more than six <br />(6) months, and <br />WHEREAS, it is the desire of this Council to amend the Codified Ordinances of the <br />City of North Olmsted by increasing the penalty under Section 549.10(b). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1 That Section 549.10 entitled "Discharging Firearms" of Chapter 549 of <br />the Codified Ordinances entitled "Weapons and Explosives" which now reads: <br />"549.10 DISCHARGING FIREARMS. <br />(a) No person shall shoot, fire or discharge a shotgun, rifle, pistol, <br />cannon, air gun or firearm of any kind, or make use of any sling, pea <br />shooter, bow and arrow, or other missile, within the City, except that <br />the provision of this section shall not apply to any military company <br />when drilling under the command of an officer thereof, or to regular <br />shooting or archery clubs, or shooting or archery ranges, having a <br />written permit from the Mayor, or to targets privately erected for <br />practice, when permitted in writing by the Mayor, or to the use of <br />firearms in the lawful defense of the person, family or property of any <br />person, or by any police officer in the lawful discharge of his duties. <br />(b) Whoever violates this section is guilty of a misdemeanor of the <br />fourth degree." <br />be and the same is hereby amended and as amended shall read as follows: <br />
