<br />CITY OF NOR1H OLrLSTED <br />ORDINAIJC6 N0. 93 -163 <br />By: George Nashar <br />AN ORDINANCE AiTPH()RT7.IlJG 7i3E MAYOR T0 S[JBMIT AN APPLICATION T0 THE <br />NORTEIE.A.S'1' CHIO ARF.I?WIDE COORDINATING AGF1qC.'Y F(l8 THE CITY TD P9RTICIPATE <br />IN THE STATE TRANSPORTATION ENRANCIIMMT PROQtAM FCHI THE CI?NS1RiJGTION OF <br />NOISE RARRTRRS, MU[INDING AND LANIDSCAPING AIANG A PORTION OF THE PROPOSED <br />CROCKER ROAD IN NOR1H OIMSTED, AMF.F.TM TU SELARE IN THE PROJFJCT COST, <br />AMKIIU T0 THE F[TIIIBE MATNI'FNANC:R OF SAID IlTROVDMI.S, AND DECLARING <br />AN IIID.tCENCY, AS ArIIMED. <br />UBEREAS, pursuant to the Intermodal Surface Transportation Act of 1991, the <br />Ohio Department of Transportation, hereinafter referred to as ODOT, is authorized <br />to establish and administer the Transportation Enhancement Program for the benefit <br />of Municipalities by providing for improvements, beyond the customary improvements, <br />when developing a transportation project, and <br />wFEtF.A-S, the Northeast Ohio Areawide Coordinating Agency, hereinafter referred to <br />as NOACA, is authorized to accept and evaluate applications from Municipalities in <br />Cuyahoga County for participation in the Transportation Enhancement Program, and <br />WHEREA.S, THE City of North Olmsted, hereinafter referred to as the MUNICIPALITY, <br />requests the cooperation of ODOT in the construction of noise barriers, mounding <br />and landscaping along a portion of the proposed Crocker Road in the City of North <br />Olmsted. <br />NOW, THIItEFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OUfSTED, COUN'TY <br />OF CUYAHOGA, AND STATE OF OHIO: <br />SFITION l: That the Mayor is hereby authorized to subm:i.t and apply to NOACA for <br />t e MUNICIPALITY to participate in the Transportation Enhancement Progream <br />administered by ODOT for the construction of noise barriers, mounding and <br />landscaping along a portion of the proposed Crocker Road in the MUNICIPALITY. <br />SECrION 2: That this Ordinance is hereby declared to be an emergency measure by <br />reason of the need to submit the application for consideration by NOACA and ODOT, <br />and provided it receives the affirmative vote of two-thirds of the members of <br />Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor; otherwise, it shall take effect and be in force from and <br />after the earliest period allowed by law.
