4 CITY OF NORTH OLMSTED RESOLUTION NO. 93-147 BY: MAYOR EDWARD BOYLE A RESOLUTION DIRECTIlVG THE MAYOR TO FILE THE REQUIRED FORM WITH THE FEDERAL COMMUrTICATIONS C0PAIlVIISSION FOR TI-E PURPOSE OF EItCISING RF.GULATORY JURISDICrION W1TH RESPECr TO RATES CHARGED FOR BASIC CABLE TELEVISION. VVHEREAS, this Council has deemed it advisable and appropriate to direct the Mayor to seek certification from the Federal Communications Commission for the purpose of regulating Basic Cable Television Service Rates; and VVHEREAS, this Council has determined that effective competition does not exist within the City of North Olmsted. NOW, THFRFFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: The Mayor is hereby directed to file form FCC328 with the Federal Communications Commission for the purpose of seeking certification of the franchising authority, City of North Olmsted, to regulate Basic Cable Service Rates. SECTION 2: The Council hereby acknowledges acceptance of its ability to administer regulations with respect to Basic Cable Service consistent with regulations adopted by the Federal Communications Commission pursuant to 47 U.S.C. Section 543 (B). SECTION 3: That any Ordinance or Resolution or parts of Ordinances or Resolutions heretofore adopted which are inconsistent herewith, are hereby specifically repealed. SECTION 4: That this Resolution hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare of the citizens of North Olmsted, and for the further reason that the Basic Cable Service Rates are not regulated at this time, and further provided it receives the affirmative notes of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
