Saringer <br />AN ORDINANCE ACCEPTING EASIIMENTS FOR 'IIiE INSTALLATION AND <br />MAINTENANCE OF A WATER MAIN FOR TEiE PURPOSE OF CIRC[TLATION <br />OF WATIIt SERVICE BY 'IIiE CITY OF CLEVELAND TO I.,AND OWNED BY MOEN <br />INCORPORATID AND W& Z PROPIItTIES, LTD. (DEVELOPERS DIVERSIFIID, <br />LTD. ) AND DECLARING AN ENIERGINCY. <br />WHEREAS, Moen Incorporated and W& Z Properties, LTD. (Developers <br />Diversified, LTD.) desire to extend a water main into their property, <br />and <br />WHII2EAS, the City of Cleveland requires that extension of water <br />lines shall only be approved if easements are granted to both the City <br />of Cleveland and the City of North Olmsted in order that water mains may <br />be constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the City to <br />accept the water main easement described herein; attached Exhibits "B" <br />and "C". <br />NOW THEREFORE, BE IT ORDAINID BY TfiE COUNCIL OF 'THE CITY OF NORTH <br />OLMSTID, COUNI'Y OF CIJYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept easements from <br />Moen Incorporated and W& Z Properties, LTD. (Developers Diversified, <br />LTD.) for the installation and maintenance of a water main for the <br />purpose of circulation of water service by the City of Cleveland to the <br />properties of Moen Incorporated and W& Z Properties, LTD. (Developers <br />Diversified, LTD.). <br />SECTION 2: That the Clerk of this Council is hereby authorized to <br />forward a certified copy of this Ordinance to the Director of Public <br />Utilities of the City of Cleveland. <br />SECTION 3: That it is found and determined that all formal actions <br />of this Council concerning and relating to the adoption of this <br />Ordinance were adopted in an open meeting of this Council, and that all <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public in compliance <br />with all legal requirements, including Section 121.22 of the Ohio <br />Revised Code.
