CITY OF NOR711 OIMLSTED <br />ORDINANCE N0. 93 - 132 <br />BY: Councilman IVashar <br />AN ORDINANCE ACCEPTING Sl'ORM S'EWER F.ASIINQITS IACATED SOTI?i OF MAP'LE <br />gIDGE ROAD IN 7HE CITY OF NOR7.S OIMS'rED, ANID DH['r.ARTAT AN fl42GENR,'Y, <br />WHEREAS, the City Engineer has recommended that the remaining portion of open <br />ditch draining the Deerfield Subdivision (approximately 270 feet in length) be <br />culverted to improve the draina.ge of stormwater frorn the Deerfield Subdivision, <br />and <br />WHEREAS, the City has agreed to pay a11 costs and expenses for culverting the <br />existirg drainage channel in its location within the new easement areas as shown <br />on the plan of the proposed Deerfield drainage system, which is marked "Exhibit A" <br />and attached hereto and made a part of this Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY 'IIHE COUNCIL OF TfiE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts the easements from the two awners of <br />property on Maple Ridge Road being Permanent Parcel Nos. 231-18-16 and 231-18-19, <br />as noted on "Exhibit A" (attached) for a new storm sewer, and which is more fully <br />set out in individual easement descriptions on file with the Engineering <br />Department, a copy of which said easements are attached hereto, and made a part <br />hereof, as though fully rewritten herein and marked "Exhibit B". <br />SECTION 2: That the granting of the new easement and construction of the new <br />storm sewer line shall be accomplished at the sole cost and expense of the City <br />of North Olmsted. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby directed to <br />cause said easements to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this Ordinance is hereby declared to be an anergency measure <br />inun Teci-atel7y necessary for the preservation of the public peace, property, health <br />and safety of the City, and further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force <br />immdiately upon its passage and approval by the Ma.yor.
