The Grantors hereby restrict said premises within the limits of the above described <br />easement against the construction thereon or above or subjacent thereto any buildings, structures, <br />improvements, tunnels, or facilities, or any kind, and the storing or placing of any materials, <br />equipment of other obstructions thereon, or excavadon therein in any manner interfering with said <br />storm sewers whatscever, the access thereto, or the maintenance thereof, or otherwise interfering <br />therewith; provided that, notwithstanding the foregoing restrictions and prohibitions, Grantors may <br />make any of the uses or do any of the things to the foregoing premises with the express written <br />consent of the Grantee. Such reserved and permitted usage shall include, in r l?ai, landscaping, <br />parking of vehicles within the regulations set forth in the Codified Ordinances, paving and the <br />maintenance thereof. <br />Grantor shall fully use and enjoy the aforesaid premises except as to the rights herein <br />granted; and Grantee does hereby agree to hold and save the said Grantor harmless for any and all <br />damages arising from its use of the right, easment, and right-of-way herein granted and agree to <br />maintain, restore to its original condition, and keep free from nuisance, said right-of-way and pay <br />any damage or damages Grantors through Grantee's use, occupation, and possession of the rights <br />herein granted. <br />Page 2
