r <br />• ?«.,-., ,,, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93-94 <br />BY.• Ed Boyle, Mayor <br />AN ORDINANCE APPROVING THE EXECUTION OF AN <br />ENTERPRISE ZONE AGREEMENT BETWEEN THE CITY OF <br />NORTH OLMSTED CUYAHOGA COUNTY AND MONEY <br />ACCESS SERVICE CORP. AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council, pursuant to ordinance No. 92-22 requested the designation of <br />certain territory of the City of North Olmsted, Ohio (the "City") as an Urban Jobs and <br />Enterprise Zone (the "Enterprise Zone"); and <br />WHEREAS, the Board of County Commissioners of the County of Cuyahoga (the <br />"County"), adopted a resolution on May 5, 1992 designating such area as an Enterprise Zone <br />pursuant to Sections 5709.61 to .66, inclusive, of the Ohio Revised Code (the "Act"); and <br />WHEREAS, effective June 8, 1992, the Director of Development of the State of Ohio <br />certified the Enterprise Zone as an Urban 7obs and Enterprise Zone under the Act; and <br />WHEREAS, Money Access Service Corp. an Ohio corporation (the "Company"), will <br />submit an application (the "Application") to the County for tax exemption for the Project <br />described in such Application; and <br />WHEREAS, the City desires to approve the execution of an Enterprise Zone Agreement <br />(the "Agreement"), a copy of which is attached hereto as Exhibit A, among the City, the County <br />and the Company in order to induce the Company to undertake the Project at the Project Site <br />(as defined in the Agreement). <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: The Mayor of the City is hereby authorized and for and in the name <br />and on behalf of the City, to execute and deliver, the Agreement in substantially the form <br />attached hereto as Exhibit A. The form of the Agreement is approved with changes therein not <br />inconsistent with this Ordinance and not substantially adverse to the City. The approval of those <br />changes as not being substantially adverse to the City shall be conclusively determined by the <br />execution of the Agreement by the Mayor.
