BY.• Ed Boyle, Mayor <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO ARTICLE Vll SECTION 2(e) OF THE <br />CHARTER, PROVIDING FOR AN EXCEPTION FOR <br />MANDATORY REFERRAL TO ELECTORS WHEN ZONING <br />TO SENIOR RESIDENCE USE, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Article VII Section 2(e) of the Charter of the City of North Olmsted <br />currently provides that all rezoning or zoning for multidwelling use "by whatever name <br />classified" when the number of dwelling units in multi-family dwellings exceeds twenty percent <br />(20%) must after approval by the Planning Commission and Council also approved by a majority <br />of electorate; and <br />WHEREAS, this council is of the belief that the aforesaid restrictions should not apply <br />to rezoning or zoning for Senior Residence use; and <br />WHEREAS, in order to eliminate the requirement for voter approval for zoning or <br />rezoning for Senior Residence use the Charter must be amended. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO. TWO THIRDS OF <br />ALL MEMBERS CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs the submission to the <br />electors of the City of North Olmsted at the General Election to be held at the usual places of <br />voting in said City on Tuesday, November 2, 1993, the following separate proposal to amend <br />the Charter of the City of North Olmsted: <br />PROPOSAL: That Article VII Section 2(e) of the Charter relating to the requirement <br />of submitting all zoning and rezoning of land for multi-family use, upon the occunence of <br />certain events, be submitted to the Electorate for approval, be amended to exclude therefrom the <br />requirement to submit to the Electorate any zoning or rezoning of land for Senior Residence use. <br />Such proposed amended Section 2(e) of Article VII shall read as follows:
