<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93- 83 <br />BY.• couNcIIt1AN DEAN MCKAY <br />AN ORDINANCE ESTABLISHING A PROCEDURE FOR <br />GRANTING CITY CONSENT TO PROPOSED CURB CUTS ON <br />LIMITED ACCESS HIGHWAYS LOCATED WITHIN THE <br />CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the State of Ohio Department of Transportation (ODOT) has, over the <br />years, granted permission to owners of property located along Brookpark Road, a limited access <br />highway, to have curb cuts onto Brookpark Road; and <br />WHEREAS, ODOT prior to authorizing such curb cuts, has required the approval of <br />the City of North Olmsted to the curb cut in the form of a letter of consent from the Mayor; and <br />WHEREAS, it is the desire of this Council to require that the Mayor consult with and <br />obtain the approval of this Council, prior to providing ODOT with a letter of consent; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor of the City of North Olmsted, prior to conveying to the <br />State of Ohio Department of Transportation (ODOT), or any other State agency with jurisdiction <br />over State limited access highways, the City of North Olmsted's consent to any curb cut onto <br />a limited access highway located within the City of North Olmsted, shall consult with and obtain <br />the consent of the Council of the City of North Olmsted for such proposed curb cut. The City <br />shall not give its consent to any such proposed curb cut unless the Council shall, by a majority <br />vote of its members, approve of the proposed curb cut at a regular or special meeting of <br />Council. <br />SECTION 2. That this ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary for the City to provide an orderly procedure to <br />granting its consent to limited access highways located within the City, and further provided that <br />it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor. <br />Passed. ?-?-
