Ordina.nce No. 93-76 <br />Page 2 <br />"(b) The Assistant Prosecutor's primary duties shall be the <br />prosecution of non-police cases, mainly those emanating from the <br />Building Division, the Engineering Division and the Service <br />Department. He shall also prosecute a111icense violations. In the <br />absence of the Police Prosecutor, the Assistant Prosecutor shall <br />also perform the Police Prosecutor's duties. " <br />Shall be, and hereby is, amended, and as amended, shall read as follows: <br />"(b) The Assistant Prosecutor's primary duties shall be the <br />prosecution of non-police cases, mainly those emanating from the <br />building division, the engineering division and the service <br />department. He shall also prosecute all license violations. In the <br />absence of the Police Prosecutor, the Assistant Prosecutor shall <br />also perform the Police Prosecutor's duties. If the Police <br />Prosecutor, for reasons of illness or otherwise, is unable to <br />perform his duties for a period in excess of three days, then the <br />Director of Law sha11 appoint the Assistant Prosecutor as Acting <br />Prosecutor, and, during such periods, the Assistant Prosecutor <br />shall be paid a salary, in addition to his salary as Assistant <br />Prosecutor, which is equal to the current salary of the Police <br />Prosecutor. In the event that the Assistant Prosecutor cannot, for <br />whatever reasons, fulfill the duties of Police Prosecutor in the <br />Police Prosecutor's absence, then the Director of Law shall <br />appoint a temporary prosecutor who shall perform the duties of the <br />Police Prosecutor in the Police Prosecutor's absence. The <br />temporary prosecutor shall be an attorney licensed to practice law <br />in the State of Ohio. While serving as temporary prosecutor, he <br />shall be paid a salary equal to the current salary of the Police <br />Prosecutor. " <br />SECTION 2: This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation for the public health, safety and welfare, and for the <br />further reason that it is immediately necessary for the services of the Prosecutor's office to the <br />public be continued in the absence of the Police Prosecutor, and further provided it receives an <br />affirmative vote of two-thirds all members of Council, it shall take effect and be enforced <br />immediately upon its passage and approval of the Mayor.
