CITY OF NORTH OLMSTED ORDINANCE NO. 93- 75 BY: MAYOR BOYLE, MR• MCKAY AN ORDINANCE AMENDING ORDINANCE NO. 93-22 ENTITLED "AN ORDINANCE ADOPTING A NEW AND REVISED 521.10 OF CHAPTER 521 ENTITLED "HEALTH, SAFETY AND SANITATION, " WHICH NEW AND REVISED SECTION SHALL BE ENTITLED "NON-SMOKING AREAS IN PLACES OF PUBLIC ASSEMBLY AND PUBLIC BUILDINGS. AS AMENDED. " BY ADDING THERETO PROVISIONS FOR PERMITlING SMOKING IN SPECIFIC AREAS OF THE POLICE DEPARTMENT. WHEREAS, This council adopted ordinance no. 93-22 on April 20, 1993; and WHEREAS, Upon confening with the Chief of Police the Safety Director advises that often times that permissible smoking in the areas of the jail and/or interrogation room aides the police in their ability to obtain cooperation from suspects or perspective witnesses; and WHEREAS, It is the desire of this Council to permit smoking in the jail area and interrogation area of the police station as herein after specified. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Ordinance 93-22 which now reads as follows: SECTION 1: That there is hereby created a new and revised Section 521.10 of Chapter 521 of the Codified Ordinances entitled "Health, Safety and Sanitation," which new and revised Section 521.10 entitled "Non-smoking areas in places of public assembly and public buildings," shall read as follows: "521.10 NON-SMOKING AREAS IN PLACE OF PUBLIC ASSEMBLY AND PUBLIC BUILDINGS. (a) As used in this section, "Place of public assembly" means: (1) Enclosed theaters, except the lobby; opera houses; auditoriums; classrooms; elevators; rooms in which persons are confined as a matter of health care, including but not limited to a hospital room and a room in a rest home serving as the residence of a person living in such rest home;
