<br />.?, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93-66 <br />BY: MAYOR EDWARD BOYLE <br />AN ORDINANCE RATIFYING AND CONFIRMING THE <br />SETTLEMENT OF THE APPROPRIATION CASE STYLED AS <br />CITY OF NORTH OLMSTED V. KERNER, ET AL. , PROBATE <br />COURT CUYAHOGA COUNTY CASE NO. 1082464 AND <br />DIRECTING THE DIRECTOR OF LAW TO FILE A <br />JUDGMENT CONFIRMING SAME, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this council by virtue of the passage of Ordinance No. 92-109 on September <br />14, 1992, declared it necessary to appropriate real property located at 24291 Lorain Road, North <br />Olmsted, Ohio, also known as Permanent Parcel No. 237-4-2, for the construction of a fire <br />station; and <br />WHEREAS, pursuant to said Ordinance the Director of Law filed an appropriation action <br />in the Probate Court seeking the appropriation of said property from its owner Edmund J. <br />Kerner; and <br />WHEREAS, the City in conformity with law obtained not only one appraisal but also a <br />second appraisal which appraisals were $229,000 and $194,000 respectfully; and <br />WHEREAS, after a number of court appearances and negotiations the matter was settled <br />pending the filing of a judgment entry for $231.,000. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this council does hereby ratify and confirm the settlement of the case <br />of City of North Olmsted v Edmund J. Kerner, et al., for the sum of $23 1,000. The Director <br />of law is hereby directed to file a 7udgment Entry settling said case upon being satisfied that the <br />property has been conveyed to the City of North Olmsted in consideration of the aforesaid <br />amount.
