,..... ?r <br />. , ?.?.?.. ? _ _ _.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93-44 <br />BY.• GEORGE NASHAR, <br />AN ORDINANCE AUTHORIZING THE BUILDING <br />COMMISSIONER TO PROCEED WITH THE DEMOLITION <br />OR REMOVAL OF THE DETACHED STRUCTURE LOCATED <br />AT 31441 LORAIN ROAD, IN THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Chapter 1331 of the Codified Ordinances of <br />the City of North Olmsted, the Building Commissioner has determined that the abandoned <br />structure Located at 31441 Lorain Road, North Olmsted, Ohio, the record title holder being <br />Raymond N. and Plaseda Chappell, is unsafe, dangerous to human life and hazardous to the <br />safety, health, and public welfare of the citizens of the City of North Olmsted; and <br />WHEREAS, notice to repair, remove, or demolish said building was sent via certified <br />mail, return receipt requested to all interested parties including Raymond N. and Plaseda <br />Chappell record title owners, at 18021 Brysdale Avenue, Cleveland, Ohio, 44135, on November <br />16, 1992, and Irene O. Wagner, Mortgagee, at 9 Parkway Drive, Olmsted Township, Ohio, <br />44138, on November 23, 1992, and the Cuyahoga County Treasurer at 1219 Ontario Street, <br />Cleveland, Ohio, 44113, on November 18, 1992, ordering said title holder and interested parties <br />to repair, remove, or demolish said building and to commence such repair, removal, or <br />demolition within sixty (60) days of receipt of said notice; and <br />WHEREAS, said record title holder, Raymond N. and Plaseda Chappell, failed to reverse <br />the Building Commissioner's order and also failed to further appeal the decision of the Board <br />of Building Code Appeals of January 28, 1993, to a higher tribunal of competent jurisdiction and <br />this time has failed to comply with the order of the Building Commission. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Council deems it necessary to proceed with the demolition and <br />removal of the unsafe structure at 31441 Lorain Road, North Olmsted, owned by Raymond N. <br />and Plaseda Chappell, whose mailing address is 18021 Brysdale Avenue, Cleveland, Ohio, <br />44135, by reason of the fact that said structure has been determined to be dangerous to human <br />life and a hazard to the public safety, health and welfare of the citizens of the City of North <br />Olmsted, Ohio, and that the cost of said demolition and removal be paid from the General Fund <br />of the City of North Olmsted and charged to the owner as a special assessment or lien on such <br />parcel of land and assessed and collected in the manner or other assessments as provided by law.
