LIlMMT AM LOIS T•7MPERT, <br />AND DEf'.IAR7NG AN EMERGIIiC.'Y. <br />WHEREAS, the City of North Olmsted desires to construct a circulating water main <br />on Duane Road, and such water main will be adjacent to the property owned by <br />Kenneth R. Limpert and Lois Limpert, and <br />WBEREAS, the City of Cleveland requires that extension of water lines shall be <br />approved only if easements are granted to both the City of Cleveland and the City <br />of North Olmsted in order that water ma.ins may be constructed and maintained <br />therein, and <br />W!-EREAS, this Council deems it in the best interest of the City to accept the <br />Water Main Easement described herein; attached Exhibit "A". <br />NOW, TIMZEFORE, BE IT ORDAINED BY THE COUNCIL OF 'IIHE CITY OF NORTH OLMSTED, <br />COUNTRY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: 'Ihat this Council does hereby accept an easement from Kenneth R. <br />Limpert and Lois Limpert for the installation and maintenance of a water main for <br />the purpose of circulation of water service by the City of Cleveland to the <br />property of Kenneth R. Limpert and Lois Limpert. <br />SECTION 2: That the Clerk of this Council is hereby authorized to forward a <br />Certifie?c Copy of this ordinance to the Director of Public Utilities of the City <br />of Cleveland. <br />SECTION 3: That it is found and determined that a11 formal actions of this <br />CounciT concerning and relating to the adoptian of this ordinance were adopted in <br />an open meeting of this Council, and that a11 deliberations of the Council and of <br />any of its committee that resulted in such formal action, were in meetings open <br />to the public in compliance with a11 legal requirements, including Section 121.22 <br />of the Ohio Revised Code. <br />SECTION 4: 'ihat this Ordinance is hereby declared to be an energency measure <br />imm?ely necessary for the preservation of the public health, safety and <br />welfare, and further provided it receives the affirmative vote of two-thirds of <br />all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Ma.yor.
