AGREEMENT FOR ENGINEERING SERVICES --ck THIS AGREEMENT made and entered into this D? day of Qg-3, by and between the CITY OF NORTH OLMSTED, OHIO, hereinafter called the "OWNER", and JOHN E. FOSTER AND ASSOCIATES, TNC., Consulting Enyineers, of Cleveland, Ohio, their successors or assigns, hereinafter called the "ENGINEER". WITNESSETH THAT: The OWNER agrees to employ the ENGINEER to furnish resident project representation services related to State Issue 2 Wastewater Treatment Plant Improvements herein referred to as the Project. For improvements the OWNER elects to implement, the ENGINEER will furnish resident services during construction as outlined in Section 1 of this Agreement. All of the services outlined above will be furnished, after authorization by the OWNER, in accordance with the provisions of Sections 1 and 2, with payment beiny made in accordance with Section 5. The UWNER and the ENGINEER in consideration of their mutual covenants herein agree in respect of the performance of resident project representation services by the ENGINEER and the payment for those services by the OWNER, as set forth below. The ENGINEER shall provide resident project representation services for the OwNER as authorized, serve as the OWNER's resident project representation representative in those phases of the Project to which this Agreement applies, and yive consultation and advice to the OWNER during the performance of services hereunder. It is mutually agreed that the ENGINEER's services shall pe under the direction and supervision of the U6vivER's Design Engineer! MALCOLM PIRNIE, INC. SECTIUN'1 - BASIC SERVICES OF THE ENGINEER 1.1 The ENGINEER shall perform professional services as defined in Engineer's Proposal dated July 14, 1993 hereinafter called "ENGINEER'S PROPOSAL", attached hereto as Exhibit A and made a part hereof. -1-
