Olmsted NgreF-- ?nt 9/27f 93 • <br />3.6 Give prompt written notice to the ENGINEER whenever the OWNER observes or <br />otherwise becomes aware of any deveTopment that affects the scope or timing of <br />the ENGINEtR's services. <br />3.7 Furnish, or direct the ENGIfVEER to provide, necessary Additional Services as <br />stipulated in paragraph 2 of the Agreement or other services as required. <br />3.8 Bear all costs incident to compliance with the requirements of this Section <br />3. <br />SECTION 4- DURATION OF SERVICES <br />4.1 Duration of services to be provided shall be as delirieated in ENGINEER'S <br />PROPOSAL attached hereto as EXHIBIT A. <br />4.2 If the OWNER has requested significant modifications or changes in the <br />extent of the Project, the time of performance of the ENGINEER's services and his <br />various rates of compensation shall be adjusted appropriately. <br />SECTION 5- PAYMENTS TO THE ENGINEER <br />5.1 Payments for Services af the ENGIh1EER under Section 1. <br />5.1.1. Payments for services to be provided shall be as delineated in <br />ENGINEER'S PROPOSAL attached hereto as EXHIBIT A. <br />5.2 Payment for Additional Services of the ENGINEER under Section 2. <br />5.2.1. The OWNER agrees to pay the ENGINEER for additional services performed <br />by the ENGINEER under Section 2 at a rate to be mutually agreed upon. <br />5.3 General <br />5.3.1. The OWNER and the ENGINEER, by mutual agreement prior-to authorization <br />to proceed, have established a maximum fee pursuant to paragraph 5.1.1. that <br />shall not be exceeded unless-the scope of the Project or the scope of services is <br />-3-
