<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2011 - 4 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PLANNING <br />AND DEVELOPMENT TO REQUEST PROPOSALS FROM FIRMS <br />QUALIFIED TO COND UCT A COMPREHENSIVE ENER GY A UDIT <br />OF VARIOUS MUNICIPAL BUILDINGS, ALL AS REQUIRED B Y <br />THE CUYAHOGA COUNTY MUNICIPAL ENERGY PROGRAM; <br />FURTHER AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE FIRM SELECTED IN THE RFP <br />PROCESS, AFTER APPROVAL BY THE BOARD OF CONTROL, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the municipal energy program ("MEP") provides assistance to political <br />subdivisions to institute energy efficiency and conservation saving projects; and <br />WHEREAS, the City of North Olmsted applied for and received $65,000.00 to perform <br />an American Society of Heating, Refrigerating and Air Conditioning Engineers ("ASHRAE") <br />level 2 energy audit of certain municipally owned buildings in order to ascertain energy <br />efficiency needs; and <br />WHEREAS, pursuant to the Grant terms the City now is in need of a qualified <br />professional to conduct the "ASHRAE" level 2 energy audit; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Director of <br />Planning and Development to solicit proposals from qualified firms. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning and Development be and she hereby is <br />authorized to request proposals (RFP) from professional firms to conduct an "ASHRAE" level 2 <br />energy audit of various municipal buildings; and <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, to enter into an Agreement with the professional firm selected in the Request for <br />Proposal process. That such Agreement be in substantially the same form of Agreement as <br />approved by the Director of Law, with only such changes to be hereinafter made as are not <br />substantially adverse to the City and which are approved by the Director of Law. The character <br />of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement <br />by the Director of Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare of this <br />City, and for the further reason that this Resolution is required to be immediately effective to <br />enable the City to expedite the RFP process and be in compliance with grant conditions and time <br />deadlines; and further provided that it receives the affirmative vote of two-thirds of all members <br />
