CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 5 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 1359 <br />OF THE BUILDING CODE ENTITLED "MAINTENANCE OF <br />UNOCCUPIED COMMERCIAL BUILDINGS" IN ORDER TO PROVIDE <br />THE DIRECTOR OF PLANNING AND DEVELOPMENT WITH <br />ADMINISTRATIVE AUTHORITY TO MONITOR VACANCIES, <br />ESTABLISH BOND AMOUNTS AND TD RECOGNIZE APPEALS FROM <br />PROPERTY OWNERS. <br />WHEREAS, this Council established various building regulations for unoccupied <br />commercial buildings by Ord. 1974-48 and further provided, upon notice of violation, for such <br />property owners to post a bond to secure real property maintenance by Ord. 2003-92; and <br />WHEREAS, through comprehensive reorganization of City Departments in 2010, the <br />Director of Planning & Development, rather than the former position of Director of Public <br />Safety, is now charged with supervisory responsibilities over matters, such as monitoring real <br />property maintenance issues, as may arise in the Building Department; and <br />WHEREAS, it is the recommendation of the Administration that the duties previously <br />assigned to the Safety Director under Chapter 1359 be reassigned to the Planning & <br />Development Director, consistent with the re-organization of the Building Departments; and <br />WHEREAS, in addition to several administrative amendments, the Directors of Planning <br />& Development and Law also recommend several substantive amendments to improve <br />enforcement mechanisms in Chapter 1359 of the Building Code, such as enabling the Planning ~, <br />Development Director to set bond amounts and to recognize a right of appeal by property <br />owners; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to adopt amendments to Chapter 1359 of the Building Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 1359 "Maintenance of Unoccupied Commercial Buildings," <br />which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance <br />and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, <br />shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance <br />and likewise incorporated by reference as if fully rewritten herein. <br />
