Passed 5-21-74.) <br />1359.05 REMOVAL OF SIGNS. <br />(a) The owner of any sign, or the owner of the premises on which it is located, shall <br />be responsible for the removal of such sign if and when the business is abandoned. Such <br />removal shall include the complete blocking out of all painted wall signs and supports, braces, <br />guys, anchors and electrical service. The removal of such signs shall be carried out within thirty <br />days after the time specified in Section 1359.03. <br />(b) In the case of noncompliance with subsection (a) hereof, the Building <br />Commissioner shall notify in writing the owner of the abandoned sign and the owner of the <br />premises on which such sign is located, or have the option to notify either one of them, ordering <br />the removal of such sign. If this order is not complied with within fourteen days after the date of <br />such order, the Building Commissioner shall remove such sign at the expense of the owner of the <br />-real estate. Passed 5-21-74.) <br />1359.06 VIOLATIONS; NOTICE TO CORRECT; NONCOMPLIANCE; <br />EQUITABLE REMEDY. <br />The Building Commissioner and/or an inspector in the Building Department, upon <br />finding a violation of any of the provisions of this chapter, shall issue a notice directing the <br />owner of such a structure and/or premises to correct or abate the violation within ten days after <br />receipt of such notice. Such service of notice shall be in the same manner as service of summons <br />in civil matters adopted by courts of record in the State. Should the owner fail to comply with <br />the notice within the time allowed, the Building Commissioner is, in addition to any penalty <br />provided in this chapter, authorized to cause the violation to be corrected and the cost for the <br />same to be assessed against the owner. (Ord. 74-48. Passed 5-21-74.) <br />1359.07 EXTENSION OF TIME. <br />The Building Commissioner may extend the times specified in Sections 1359.05 and <br />1359.06. However, no extension shall exceed a period of thirty days from the expiration of time <br />given in the first notice. <br />(Ord. 74-48. Passed 5-21-74.) <br />1359.08 INFORMATION TO BE PROVIDED REGARDING UNOCCUPIED <br />COMMERCIAL BUILDING. <br />Upon receiving information that the Building Commissioner has issued a notice to <br />correct or abate pursuant to Section 1359.06 of this chapter to the owner of an unoccupied <br />commercial building, the Director of Public Safety shall immediately in writing notify the owner <br />that, within three business days, he must provide the City in writing with such information as <br />may be required by the Building Commissioner for the proper enforcement of this chapter, as <br />well as any other information deemed necessary for the proper administration of this Title, <br />including the following information: <br />(a) Name, address and telephone number of owner (other than property address); <br />(b) Name, address and telephone number of property manager or custodian; <br />(c) Name, address and telephone number of real estate agent or other <br />representatives; <br />(d) Name, address and telephone number of landscape service company; <br />(e) Emergency contact information in addition to the above. <br />(Ord. 2003-92. Passed 6-17-03.) <br />1359.09 PROPERTY MAINTENANCE BOND. <br />(a) The owner shall in all cases be responsible for performing and liable for all costs <br />associated with or expenses incurred to maintain the unoccupied building and premises following <br />its vacancy and pursuant to the requirements of this chapter.
