CHAPTER 1359 <br /> EXHIBIT <br /> <br />~ I(- S <br />Maintenance of Unoccupied Commercial Buildings <br />1359.01 Definitions. <br />1359.02 Purpose. <br />1359.03 General maintenance. <br />1359.04 Boarding of structures. <br />1359.05 Removal of signs. <br />1359.06 Violations; notice to correct; <br />noncompliance; equitable remedy. <br />1359.07 Extension of time. <br />1359.08 Information to be provided <br />regarding unoccupied commercial <br />building. <br />1359.09 Property maintenance bond. <br />1359.99 Penalty. <br />1359.01 DEFINITIONS. <br />As used in this chapter: <br />(a) "Unoccupied commercial building" means any building, including the land on <br />which it is situated, which is used or intended to be used for the retail, <br />commercial, or business occupancy within which commercial transactions have <br />ceased and been abandoned for a period in excess of thirty days. <br />(b) "Refuse" means all putrescible and nonputrescible solid waste (except body <br />waste), including, but not limited to, garbage, rubbish, ashes, street cleanings, <br />dead animals and solid market and industrial wastes. <br />(c) "Garbage" means putrescible animal and vegetable waste resulting from the <br />handling, preparation, cooking and consumption of food. <br />(d) "Natural growth" shall include dead trees and limbs and other natural growths <br />which, by reason of rotting or deteriorating conditions or storm damage, <br />constitute a hazard to persons in the vicinity thereof. "Natural growth" shall <br />also refer to and include any and all planted materials, bushes, shrubbery, <br />ground cover, grass areas, or lawns, and other landscaping materials, however <br />described, and which, by reason of weed infestation, overgrowth or lack of <br />trimming or pruning, constitute a nuisance or otherwise violate Section <br />1363.07(b)(1) or Section 949.03. <br />(e) "Exterior of the premises" means those portions of a building which are exposed <br />to public view and the open space of any premises outside of any building <br />erected thereon. <br />(f) "Owner" means an owner of premises, including a holder of title thereto subject <br />to contract or purchase, a trustee, a vendee in possession, a mortgagee or <br />receiver in possession, a lessee or joint lessees of the whole thereof, a tenant, an <br />agent or any other person, firm, corporation or fiduciary directly in control of <br />premises. <br />1359.02 PURPOSE. <br />The purpose of this chapter is to establish minimum standards for the maintenance of <br />land and buildings used for commercial purposes which have ceased business for a period of <br />
