CITY OF NORTH OLMSTED ORDINANCE N0.20ll -12 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 1 SI OF THE ADMINISTRATIVE CODE ENTITLED "BOARD OF ZONING APPEALS" IN ORDER TO CREATE THE POSITION OF VICE CHAIRMAN AND TO ELIMINA TE REFERENCE TO FEES, AS AMENDED. WHEREAS, for the purpose of efficiency and to ensure the smooth operation of business before the Commission, it is the recommendation of the Administration that the Board of Zoning Appeals be permitted to create the position of Vice Chairman to act in the absence of the Chairman; and WHEREAS, it is the recommendation of the Administration that reference to hearing fees be abolished as redundant; and WHEREAS, it is the desire of this Council, consistent with the recommendations of the Administration, to create the position of Vice Chairman and to remove reference to hearing fees, as the same are detailed in other ordinances. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 151 "Board of Zoning Appeals" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re-codification. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law. PASSED: ~~ l ~ ~'- ~~L / t O-~.~!
