CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011-19 <br />BY: Council Member Orlowski <br />AN ORDINANCE ENACTING NEW SECTION SO5.18 OF CHAPTER <br />SOS (ANIMALS AND FOWL) OF THE GENERAL OFFENSES <br />CODE, ENTITLED "ASSAULTING OR HARASSING POLICE DOG <br />OR HORSE OR SERVICE DOG" IN ORDER TO PROHIBIT <br />ANIMAL ABUSE. <br />WHEREAS, it is the desire of this Council to adopt and incorporate provisions of <br />State law which prohibit assault or harassment of police dogs, horses or service animals <br />in order to prohibit such animal abuse and to penalize offenses; and <br />WHEREAS, it is accordingly the desire of this Council to enact new Section <br />505.18 of the General Offenses Code in order impose prohibitions against and penalties <br />for engaging in acts of assault or harassment of police or service animals in order to <br />protect the health, safety and welfare of North Olmsted residents; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 505.18 of Chapter 505 (Animals and Fowl) of the <br />General Offenses Code, be enacted and as enacted shall reads as follows: <br />505.18 ASSAULTING OR HARASSING POLICE DOG OR HORSE OR <br />SERVICE DOG. <br />(a) No person shall knowingly cause, or attempt to cause, physical harm to a <br />police dog or horse in either of the following circumstances: <br />(1) The police dog or horse is assisting a law enforcement officer in the <br />performance of the officer's official duties at the time the physical harm is <br />caused or attempted. <br />(2) The police dog or horse is not assisting a law enforcement officer in <br />the performance of the officer's official duties at the time the physical <br />harm is caused or attempted, but the offender has actual knowledge that <br />the dog or horse is a police dog or horse. <br />(b) No person shall recklessly do any of the following: <br />(1) Taunt, torment, or strike a police dog or horse; <br />
