CITY OF NORTH OLMSTED ORDINANCE N0.2011- 20 BY: Council Member Orlowski AN ORDINANCE ENACTING NEW SECTION 505.17 OF CHAPTER 505 (ANIMALS AND FOWL) OF THE GENERAL OFFENSES CODE, ENTITLED "ANIMAL FIGHTING PROHIBITED" IN ORDER TO PROHIBIT SUCHANIMAL ABUSE. WHEREAS, it is the desire of this Council to adopt and incorporate provisions of State law which prohibit animal fighting in order to prohibit animal abuse and to penalize such offenses more severely than State law; and WHEREAS, it is accordingly the desire of this Council to enact new Section 505.17 of the General Offenses Code in order impose prohibitions against and penalties for engaging in animal fighting in order to protect the health, safety and welfare of North Olmsted residents; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 505.17 of Chapter 505 (Animals and Fowl) of the General Offenses Code, be enacted and as enacted shall reads as follows: 505.17 ANIMAL FIGHTING PROHIBITED (a) No person shall knowingly engage in or be employed at cockfighting, bearbaiting, or pitting an animal against another; no person shall receive money for the admission of another to a place kept for such purpose; no person shall use, train, or possess any animal for seizing, detaining, or maltreating a domestic animal. Any person who knowingly purchases a ticket of admission to such place, or is present thereat, or witnesses such spectacle, is an aider and abettor. (R.C. 959.15) (b) Any person who violates this section is guilty of a misdemeanor of the first degree. SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law.
