SECTION 2: That the Mayor be and he is hereby authorized to enter an agreement with or contract for the service of a demolition contractor, as necessary to secure the services of such a demolition contractor recommended by the Planning & Development Director, to provide for and proceed with the razing of all dangerous buildings located at 5430 Sunset Oval, City of North Olmsted, which contract shall be in a legal form and contain substance deemed necessary by the Director of Law. SECTION 3: That the Clerk of Council be and she is hereby directed, with the assistance and direction of the Director of Finance and the Director of Law, to certify the entire cost of demolition, including the cost of service, all interest and penalties allowed by law, together with a proper legal description of the premises at 5430 Sunset Oval, to the office of the Cuyahoga County Auditor, which shall thereby constitute a tax lien vested and granted priority pursuant to Ohio Revised Code §§ 715.26 and 715.261. SECTION 4: That the Clerk of Council be and she is hereby directed to forward a copy of this Ordinance by certified mail to the property owner, lienholders and all other persons having an interest in the property, as the names and addresses appear in the records of the Building Commissioner and the Board of Building Code Appeals. SECTION 5: That this Council finds that sufficient funds have been appropriated for the expenditures relating to the subject demolition and removal service contract, which shall not exceed the amount of $25,000.00, and hereby approves payments to be made by the Director of Finance that are consistent with the provisions of this Ordinance. SECTION 6. That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this legislation be effective immediately so that the public nuisance can abated by the City expeditiously, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
