CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 33 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RESTATING SECTION 957.01 OF <br />CHAPTER 957 (ALCOHOLIC BEVERAGES ON PUBLIC GROUNDS) OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED IN <br />ORDER TO ESTABLISH A REVISED SYSTEM FOR FUTURE <br />APPROVALS OF ONE-TIME ALCOHOL SALES AND CONSUMPTION IN <br />THE COMMUNITY CABIN, AS AMENDED. <br />WHEREAS, in 2010 the Council permitted the VFW, Post 7647 to sell and consume <br />aleehel beer at the VFW tent at the North Olmsted Park, during the annual, licensed <br />Homecoming Festival from Thursday, August 26, 2010 through Sunday, August 29, 2010; and <br />WHEREAS, the process during Homecoming was orderly and uneventful; and <br />WHEREAS, the City of North Olmsted in 2010 undertook and completed renovations to <br />the Community Cabin that result in the Community Cabin being more amenable to rental for, <br />among other things, retirement parties, bridal showers, birthday parties and charity fundraisers; <br />and <br />WHEREAS, the City can realize greater revenue on its asset, become more competitive <br />with municipal facilities like the Don Ummerly Civil Center in Rocky River and generally <br />increase marketability by permitting, on a limited basis, the sale and consumption of alcoholic <br />beverages on City property; and <br />WHEREAS, a more orderly system of future approvals for alcohol sales and <br />consumption should be established by and through vesting the Director of Public Safety with <br />authority to permit the sale and consumption of alcoholic beverage on public grounds under such <br />restrictions as he deems necessary to protect the public health, safety and welfare. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 957.01 of Chapter 957 (Alcoholic Beverages on Public <br />Grounds) of the Codified Ordinances, which currently reads as follows: <br />957.01 PERMITTED CIRCUMSTANCES. <br />The sale and consumption of alcoholic beverages shall be permitted despite the <br />provisions of Section 529.09 prohibiting such sale and consumption, only under the following <br />specific circumstances. <br />(a) The prohibition of possession, use, sale or consumption of alcoholic beverages in <br />
