CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2011 - 40 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 139.99 OF CHAPTER 139 OF <br />THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF PUBLIC <br />SAFETY" IN ORDER TD CREATE THE POSITION OFADMINISTRATIVE <br />ASSISTANT WITHIN THE DIVISION OF FIRE, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Ordinance 2010- ~ (effective August 1, 2010) amended and re- <br />established the organization of the Department of Public Safety and the divisions within that <br />Department; and <br />WHEREAS, it has been determined by the Director of Public Safety that a reallocation of <br />responsibility is in order within the Division of Fire; and <br />WHEREAS, it is the recommendation of the Administration that the Department of <br />Public Safety. Division of Fire additionally be comprised of an Administrative Assistant to the <br />Chief of Fire; and <br />WHEREAS, consistent with the recommendation of the Administration, it is the desire of <br />this Council to amend the employee positions found within section 139.99 "Composition and <br />Organization. of the Department of Public Safety" by amending Chapter 139 of the <br />Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 139.99 "Composition and Organization of the Department of <br />Public Safety" which presently reads in its entirety as set forth in Exhibit A, which is attached to <br />this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, <br />as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this <br />Ordinance and likewise incorporated by reference as if fully rewritten herein. <br />SF,CTION 2: "That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance go into effect immediately so as to reflect <br />the allocation of responsibility within the Department of Public Safety, Division of Fire, and <br />
