CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 48 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE FOR <br />SERVICE DEPARTMENT USE SIXTY FOUR (64) MOTOROLA RADIOS, <br />ALL THROUGH THE STATE PURCHASE PROGRAM; AND FURTHER <br />AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS <br />NECESSARY TO EFFECTUATE SUCH PURCHASE. <br />WHEREAS, the Mayor has recommended to this Council that the City purchase fifty <br />eight (58) Motorola CM200 Mobile Radios and six (6) Motorola CP200 Portable Radios; and <br />WHEREAS, said radios will comply with FCC restrictions for communication devices <br />beginning, respectively, January 1, 2011 and January 1, 2013; and <br />WHEREAS, the purchase of said radios, although in excess of Twenty-Five Thousand <br />Dollars ($25,000), is not legally required by the City Charter to be competitively bid locally, <br />because said item is being purchased through the State Purchase Program, which is deemed <br />under the City Charter to meet the Charter requirements for competitive bidding; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the <br />hereinbefore referenced radios and equipment through the State Purchase Program, and further to <br />authorize the Mayor to execute all documents necessary to effectuate said purchase. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase, through the <br />State Purchasing Program, which was established by R.C. §125.04 and which the City is <br />authorized to participate in pursuant to Ordinance No. 87-6 and the City Charter: <br />Fifty eight (58) Motorola CM200 Mobile Radios and Six (6) Motorola CP200 Portable <br />Radios from B & C Communications for the price of $26,969.60. <br />SECTION 2: The Mayor is hereby authorized to execute any contract and/or other <br />appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such <br />contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions <br />of this Resolution and approved by the Director of Law. <br />SECTION 3: That this Resolution shall take effect and be in force from and after the <br />earliest period allowed by law. <br />
