CITY OF NORTH OLMSTED RESOLUTION N0.2011 - 48 By: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE FOR SERVICE DEPARTMENT USE SIXTY FOUR (64) MOTOROLA RADIOS, ALL THROUGH THE STATE PURCHASE PROGRAM; AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO EFFECTUATE SUCH PURCHASE. WHEREAS, the Mayor has recommended to this Council that the City purchase fifty eight (58) Motorola CM200 Mobile Radios and six (6) Motorola CP200 Portable Radios; and WHEREAS, said radios will comply with FCC restrictions for communication devices beginning, respectively, January 1, 2011 and January 1, 2013; and WHEREAS, the purchase of said radios, although in excess of Twenty-Five Thousand Dollars ($25,000), is not legally required by the City Charter to be competitively bid locally, because said item is being purchased through the State Purchase Program, which is deemed under the City Charter to meet the Charter requirements for competitive bidding; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the hereinbefore referenced radios and equipment through the State Purchase Program, and further to authorize the Mayor to execute all documents necessary to effectuate said purchase. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase, through the State Purchasing Program, which was established by R.C. §125.04 and which the City is authorized to participate in pursuant to Ordinance No. 87-6 and the City Charter: Fifty eight (58) Motorola CM200 Mobile Radios and Six (6) Motorola CP200 Portable Radios from B & C Communications for the price of $26,969.60. SECTION 2: The Mayor is hereby authorized to execute any contract and/or other appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and approved by the Director of Law. SECTION 3: That this Resolution shall take effect and be in force from and after the earliest period allowed by law.
