CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 54 <br />BY: Mayor Kermedy <br />AN ORDINANCE AMENDING AND RESTATING SECTION 1345.05 OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED "STANDARDSS FOR RESIDENTIAL POOLS" IN ORDER TO <br />INCORPORATE THE 2006 INTERNATIONAL RESIDENTIAL CODE <br />STANDARDS FOR RESIDENTIAL POOLS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Building Commissioner has proposed amendment of Section 1345.05 in <br />order to incorporate by reference the standards set forth in Chapter 41 and Appendix D of the <br />2006 International Residential Code; and <br />WHEREAS, the standards for residential pools currently in effect were last adopted in <br />1966 and are no longer effective; and <br />WHEREAS, it is the desire of this Council to amend Building Code Section 1345.05 of <br />the Codified Ordinances of the City of North Olmsted to provide for the health, safety and <br />general welfare of residents and to improve safety standards in connection with residential pools. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1345.05, "Standards for Residential Pools," which presently <br />reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and <br />incorporated by reference as if fully rewritten herein, shall be amended and restated, and as <br />amended and restated shall read in its entirety as set forth in Exhibit B, which is likewise <br />attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is necessary that this legislation go into effect immediately because <br />residential pool applications increase seasonally; and further provided that it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: ~ /~(,~~ r~ ~ ~ A ~ ~ ~ First Reading: ~~~ ~~-~' I ~ <br />Second Reading: (e__/ ~~yly i <br />Third Reading: ~r /~,(~~/~ <br />
