CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 58 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 141.99 OF CHAPTER 141 OF <br />THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF PUBLIC <br />SERVICE" IN ORDER TO ACCURATELY REFLECT THE POSITION OF <br />MECHANIC HELPER WITHIN THE DIVISION OF FLEET, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Ordinance 2010-65 (effective August 1, 2010) amended and re-established <br />the organization of the Department of Public Service and the divisions within that Department; <br />and <br />WHEREAS, it has been determined that the position of Mechanic Helper was <br />inadvertently omitted from the composition and organization of the Department, as detailed in <br />141.99(c) ;and <br />WHEREAS, it is the recommendation of the Mayor that the position be included in the <br />organization of the Department; and <br />WHEREAS, consistent with the recommendation of the Mayor, it is the desire of this <br />Council to amend the employee positions found within section 141.99 "Composition and <br />Organization of the Department of Public Service" by amending Chapter 141 of the <br />Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 141.99 "Composition and Organization of the Department of <br />Public Service" which presently reads in its entirety as set forth in Exhibit A, which is attached <br />to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended <br />and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to <br />this Ordinance and likewise incorporated by reference as if fully rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance go into effect immediately so as to reflect <br />the current, actual composition of the Department of Public Service and further provided it <br />
