CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 59 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE ONE <br />RESCUE SQUAD FIRE APPARATUS FOR THE NORTH OLMSTED FIRE <br />DEPARTMENT THROUGH THE STATE PURCHASE PROGRAM; <br />FURTHER AUTHORIZING THE MAYOR TO EXECUTE NECESSARY <br />CONTRACT DOCUMENTS; AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the City of North Olmsted replace one of <br />the rescue squad apparatus deployed by its Fire Department due to its age and mileage; and <br />WHEREAS, the replacement of this rescue squad apparatus will protect the health, safety <br />and general welfare of North Olmsted residents and other citizens by supplying the Fire <br />Department with new and better apparatus equipment to insure the continued safety of citizens <br />and fire fighters during emergency responses; and <br />WHEREAS, Council has, by separate legislation, addressed the necessary appropriations <br />for this purchase, which is exempt trom public bidding through the State Purchasing Program; <br />and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the subject <br />rescue squad fire apparatus through the State Purchase Program for use at Fire Station No. 2 <br />only, as a permitted exception to the competitive bidding procedure that otherwise would be <br />required for such expenditure, and to further authorize the Mayor to execute any necessary <br />contract documents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />State Purchasing Program, which was established by O.R.C. Section 125.04 and which the City <br />is authorized to participate in pursuant to Charter, one (1) new rescue squad fire apparatus <br />consisting of the make and model, and containing such equipment, as is described in the <br />specifications on file in the Fire Department. Such apparatus shall only be stationed at Fire <br />Station No. 2. If necessary to effectuate any such purchase through the State Purchasing <br />Program, the Mayor is hereby authorized to execute any contract and/or other appropriate <br />documents required by the authorized vendor(s) or the State of Ohio. Any such contracts j <br />executed by the Mayor shall be in a form and substance consistent with the provisions of this <br />Ordinance and approved by the Director of Law. <br />
