CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 61 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PLANNING <br />& DEVELOPMENT TO SOLICIT BIDS FOR THE DEMOLITION <br />AND REMOVAL OF DANGEROUS BUILDINGS LOCATED AT 6652 <br />CHARLES ROAD AS A PUBLIC NUISANCE; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Building Commissioner has determined that the building located <br />at 6652 Charles Road, North Olmsted, OH 44070 is both dangerous and constitutes a <br />public nuisance as defined by NOCO § 1131.01 and 1331.03 and, due to the extensive <br />deterioration of this vacant and unsafe structure, is ordering demolition and removal <br />thereof to abate the nuisance; and <br />WHEREAS, the Building Commissioner is, in accordance with NOCO § 1331.04, <br />issuing notification to the property owner, lienholders or others having an interest in said <br />property as to the determination of that the building is a dangerous building, the existence <br />of nuisance conditions and ordered abatement by demolition; and <br />WHEREAS, it is the desire of this Council, in accordance with NOCO § 1331.05, <br />to cause the dangerous building located at 6652 Charles Road in the City of North <br />Olmsted to be demolished and removed in order to abate the public nuisance arising <br />therefrom if the property owner, lienholders and others having an interest in the property <br />fail to request the hearing provided for in NOCO § 1331.05(b) or fail to demolish the <br />building as required by the Building Commissioner's order. <br />NOW, THEREFORE, BE IT RESOL VED B Y THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning and Development be and she is <br />hereby authorized to proceed with, arrange for, and initiate all reasonable measures, <br />either directly or through the Building Commissioner, to solicit bids for demolition and <br />removal of the dangerous building located at 6652 Charles Road, City of North Olmsted, <br />based upon demolition Orders issued pursuant to Chapter 1331 of the Codified <br />Ordinances, and based on the finding of this Council that it is necessary for the City of <br />North Olmsted to cause such demolition to proceed pursuant NOCO § 1331.05 to protect <br />the health, safety and general welfare of the citizens. <br />SECTION 2: That the Mayor be and he is hereby authorized to enter an <br />agreement with or contract for the service of a demolition contractor, as necessary to <br />secure the services of such a demolition contractor recommended by the Planning & <br />
