CITY OF NORTH OLMSTED ORDINANCE N0.2011 - 65 By: Mayor Kennedy AN ORDINANCE AMENDING SECTION 1139.01 OF THE NORTH OLMSTED ZONING CODE ENTITLED "GENERAL RETAIL BUSINESS DISTRICT" TO PERMIT RELIGIOUS USES, INCLUDING CHURCHES AND RELATED B UILDINGS, AS AMENDED. WHEREAS, the City Zoning Code does not specifically address religious uses within the General Retail Business District and, consequently, any such proposed uses have been required to obtain a conditional use permit in accordance with provisions for residential zoning districts; and WHEREAS, it is the recommendation of the Director of Planning and the Director of Law that religious uses be specifically addressed in and permitted within the General Retail Business District because, among several reasons, the volume of traffic generation and associated activities for such religious uses are readily compared to and consistent with existing commercial activities in said General Retail Business District; and WHEREAS, after careful consideration, the Planning and Design Commission of the City, on the ~_ day of ~~~Q,,, , 2011, by formal motion, recommended that this Ordinance amending Section 1139.01 of the Zoning Code, entitled "General Retail Business District," be (a roved (disapproved); and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the ~ day of c ~ ~~, 2011; and WHEREAS, it is the desire of this Council to amend the uses permitted in the General Retail Business District to provide for religious uses, including churches and related structures; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 1 l 39.01 of the Zoning Code of the City of North which reads as follov~~s: 1139.01 GENERAL RETAIL BUSINESS DISTRICT. (a) Intent. For the purposes of the Zoning Code, General Retail Business Districts are hereby established to meet the shopping, convenience and service needs of the residents of the entire community and shall be established in a manner to protect adjacent residential neighborhoods by regulating the types of business uses, which could create hazards, noise, odors or other objectionable influences.
