CITY OF NORTH OLMSTED RESOLUTION N0.2011 - 67 By: Mayor Kennedy A RESOL UTION A UTHORIZING THE MAYOR TO PURCHASE ONE (1) JOHN DEERE 2011 MODEL 1200A BUNKER RAKE & COMPONENTS THROUGH THE STATE PURCHASE PROGRAM AND AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO EFFECTUATE SUCH PURCHASE, AND DECLARING AN EMERGENCY. WHEREAS, the Mayor has recommended to this Council that the City purchase one (1) John Deere 2011 Model 1200A Bunker Rake & components through the State of Ohio Purchasing Program to provide for maintenance of Springvale Golf course; and WHEREAS, said equipment is essential to the continued provision of service to the patrons at Springvale Golf Course and within the appropriation limitations reviewed with Council; and WHEREAS, that the purchase of said equipment, which is below Twenty-Five Thousand Dollars ($25,000), is not legally required by the City Charter to be competitively bid locally, because said items are being purchased through the State of Ohio purchasing program as such, and therefore are exempted under the City Charter from requirements for competitive bidding; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the hereinbefore referenced equipment and further to authorize the Mayor to execute all documents necessary to effectuate said purchase. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase, through the State Purchasing Program, which was established by R.C. §125.04 and which the City is authorized to participate in pursuant to Ordinance No. 87-6 and the City Charter: (a) One (1) John Deere 2011 Model 1200A Bunker Rake & components from Reynolds John Deere Golf for the price of $9,805.71 (Quote attached as Exhibit A). SECTION 2: The Mayor is hereby authorized to execute any contract and/or other appropriate documents required by the aforesaid vendor and in conjunction with Exhibit A attached hereto. Any such contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and approved by the Director of Law.
