CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 68 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER <br />INTD A RENEWED ONE-YEAR CONTRACT WITH LK <br />HEATING & COOLING, INC. WITH A CITY OPTION FOR <br />AN ADDITIONAL ONE YEAR TERM, TO PERFORM <br />MAINTENANCE SERVICES UPON THE HEATING AND <br />COOLING EQUIPMENT AT VARIOUS CITY BUILDINGS, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Service Department has solicited quotes from several heating <br />and air conditioning contractors to perform routine equipment maintenance at several <br />City buildings and has graphically displayed and attached the cost comparison for review; <br />and <br />WHEREAS, the Mayor has recommended that the City renew its maintenance <br />contract with LK Heating & Cooling for the purpose of providing maintenance services to <br />the heating and cooling equipment at various City buildings because the service has been <br />good and their prices have remained low; and <br />WHEREAS, it is the desire of this Council, acting upon the said <br />recommendation, to authorize the Mayor to enter into a renewed one-year contract with <br />LK Heating & Cooling Inc., with a City option for an additional one-year term, to provide <br />said services; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a <br />renewed one-year agreement with LK Heating & Cooling Inc., with a City option for a <br />second one-year term at the same prices and upon the same terms and conditions, to <br />provide maintenance upon the heating and cooling equipment in various City facilities, as <br />set forth in the attached nine contracts (collectively marked as Exhibit A), with only such <br />changes to said contracts to be hereinafter made as are not substantially adverse to the <br />City and which are approved by the Director of Law. The character of any such changes <br />as not being substantially adverse to the City shall be evidenced conclusively by the <br />execution of the agreements by the Mayor and the approval of the agreements by the <br />Director of Law. <br />SECTION 2: That this Council declares that sufficient funds have been <br />provided for the expenditures relating to the aforesaid Agreement in the amount of Nine <br />
