CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 70 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO REQUEST <br />PROPOSALS FROM FIRMS QUALIFIED TO CONDUCT A <br />COMPREHENSIVE CURBSIDE LEAF COLLECTIONPROGRAM; <br />FURTHER AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE FIRM SELECTED IN THE RFP <br />PROCESS, AFTER APPROVAL BY THE BOARD OF CONTROL, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted for years has provided to its residents a service of <br />collecting leaves from the curb each autumn; and <br />WHEREAS, the City of North Olmsted desires to continue the program in 2011; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to solicit <br />proposals from qualified firms. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to request proposals (RFP) <br />from firms to conduct a curbside leaf collection, disposal and composting program, all as set <br />forth in specifications on file in the Department of Public Service; and <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, to enter into an Agreement with the firm selected in the Request for Proposal process. <br />That such Agreement be in substantially the same form of Agreement as approved by the <br />Director of Law, with only such changes to be hereinafter made as are not substantially adverse <br />to the City and which are approved by the Director of Law. The character of any such changes <br />as not being substantially adverse to the City shall be evidenced conclusively by the execution of <br />the Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare of this <br />City, and for the further reason that this Resolution is required to be immediately effective to <br />enable the City to expedite the RFP process in order to have in place, if necessary, a firm to <br />conduct a leaf collection program for 2011; and further provided that it receives the affirmative <br />vote of two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />PASSED: c~_ fi~~ ~ I <br />ATTEST: <br />First Reading: _ ~ / 7~ <br />Second Reading: -b~F~L / / <br />Third Reading: ~~~t~,, ' <br />Committee: ~~J~~ ~''ly~~ f~ ~~~ ~ <br />
