CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 79 <br />BY: Mayor Kennedy <br />A RESOLUTION DISPENSING WITH THE RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO TWO (2) CONTRACTS <br />WITH THE BENESCH LAW FIRM FOR THE PURPOSE OF <br />PROVIDING LEGAL SERVICES RELATED TO THE ENGINEERING <br />AND CONSTRUCTION OF THE COLLECTION SYSTEM AND WASTE <br />WATER TREATMENT PLANT UPGRADES, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Mayor and Director of Law believe that additional legal professional <br />assistance is necessary advising on the contractual relationship between the City and the <br />engineering firm of Hazen and Sawyer; and <br />WHEREAS, the Benesch Law Firm has proposed to review and / or propose a new <br />and revised contract between the City and Hazen and Sawyer as well as to review and / or <br />propose front-end bid documents and contracts with vendors for the construction of the <br />collection system and Waste Water Treatment Plant modifications; and <br />WHEREAS, the proposed scope of service costs do not exceed ten thousand dollars <br />($10,000.00); and <br />WHEREAS, given the proclivity of vendors to demand additional compensation post <br />construction, developing trends in construction law, the significant tax dollars to be expended <br />in the project and the complexity of the project itself, the Mayor believes that it is in the best <br />interests of the City of North Olmsted to utilize the services of the Benesch Law Firm given <br />its breadth of construction knowledge on projects of this scope and type; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the <br />recommendation of the Mayor, to dispense with the RFP/RFQ process and authorize the <br />Mayor to enter into contracts with the Benesch Law Firm. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTI' OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into contracts <br />with the Benesch Law Firm, to provide legal services to the City relative to the engineering <br />and construction of the collection system and waste water treatment plant upgrades. Said <br />contracts shall be in substantially the same form and substance as the contracts attached hereto <br />as Exhibit A, with only such changes thereto as are not substantially adverse to the City and <br />which are approved by the Director of Law.
