CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 108 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 141.99 OF CHAPTER 141 OF <br />THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF PUBLIC <br />SERVICE" IN ORDER TO CREATE THE POSITIONS OF ASSISTANT <br />SUPERINTENDENT MAINTENANCE AND PART TIME /SEASONAL <br />HELP WITHIN THE DIVISION OF WASTEWATER, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, Ordinance 2010-65 (effective August 1, 2010) amended and re-established <br />the organization of the Department of Public Service and the divisions within that Department; <br />and <br />WHEREAS, it has been determined by the Superintendant of the Division of Wastewater <br />that the position of Assistant Superintendent Maintenance and the creation of Part Time / <br />Seasonal Help are necessary elements to the continued and future efficient operation of the <br />Wastewater Treatment Plant and collections system; and <br />WHEREAS, it is the recommendation of the Mayor, Director of Public Service and the <br />Superintendent of the Division of Wastewater that the positions referenced herein be included in <br />the organization of said Division and Department; and <br />WHEREAS, consistent with the recommendation of the Mayor, Director of Public <br />Service and Superintendent of the Division of Wastewater, it is the desire of this Council to <br />amend the employee positions found within section 141.99 "Composition and Organization of <br />the Department of Public Service" by amending Chapter 141.99(d) of the Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 141.99 "Composition and Organization of the Department of <br />Public Service" which presently reads in its entirety as set forth in Exhibit A, which is attached <br />to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended <br />and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to <br />this Ordinance and likewise incorporated by reference as if frilly rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />
