CITY OF NORTH OLMSTED <br />RESOLUTION N0.2011 - 110 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO ADVERTISE FOR BIDS FOR THE AWARD OF A CONTRACT TO <br />PROVIDE CONSTRUCTION SERVICES FOR THE BURNS ROAD <br />CULVERT REPLACEMENT PROJECT, AS DETAILED IN THE <br />SPECIFICATIONS ON FILE WITH THE ENGINEER, AND <br />AUTHORIZING THE MAYOR, FOLLOWING APPROVAL OF THE BOARD <br />OF CONTROL, TO CONTRACT FOR THE SAME WITH THE LOWEST <br />AND BEST BIDDER, AND DECLARING AN EMERGENCY. <br />WHEREAS, inspection in 2009 by the Cuyahoga County Engineer revealed a need to <br />replace a certain 4.5' x 5' x 61.5' culvert between house numbers 5566 and 5577 on Burns Road; <br />and <br />WHEREAS, the culvert has continued to deteriorate and is now, despite temporary <br />repairs, at the end of its useful life and in need of replacement; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Service to <br />advertise for bids for the award of a contract to replace said culvert on Burns Road, as set forth in <br />said specifications, and to further authorize the Mayor, following approval by the Board of <br />Control, to enter into a contract with the lowest and best bidder. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />advertise for bids for the award of a contract to replace a culvert on Burns Road, as detailed in <br />the specifications now on file with the Engineer, and that the Mayor, following approval by the <br />Board of Control, is hereby authorized to execute a contract on behalf of the City with the lowest <br />and best bidder. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately in order to <br />establish a bid opening deadline during the winter season, all the while expediting the process to <br />repair the deteriorated culvert; and further provided it receives the affirmative vote oftwo-thirds <br />of all members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
