CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 118 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 179.99 OF CHAPTER 179 OF <br />THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF <br />PLANNING AND DEVELOPMENT" IN ORDER TO CREATE THE <br />POSITION OF ASSISTANT BUILDING COMMISSIONER WITHIN THE <br />DI VISION OF B UILDING, AND DECLARING AN EMER GENCY. <br />WHEREAS, Ordinance 2010-63 (effective August 1, 2010) amended and re-established <br />the organization of the Department of Planning and Development and the divisions within that <br />Department; and <br />WHEREAS, it has been determined by the Director of Planning and Development that a <br />reallocation of responsibility is in order within the Division of Building; and <br />WHEREAS, it is the recommendation of the Administration that the Department of <br />Planning and Development, Division of Building additionally be comprised of an Assistant <br />Building Commissioner; and <br />WHEREAS, consistent with the recommendation of the Administration, it is the desire of <br />this Council to amend the employee positions found within section 179.99 "Composition and <br />Organization of the Department of Planning and Development" by amending Chapter 179 of the <br />Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 179.99 "Composition and Organization of the Department of <br />Planning and Development" which presently reads in its entirety as set forth in Exhibit A, which <br />is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be <br />amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise <br />attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance go into effect immediately so as to reflect <br />the allocation of responsibility within the Department of Plamiing and Development, Division of <br />Building before December 31, 201 1, and further provided it receives the affirmative vote of two- <br />
