CITY OF NORTH OLMSTED ORDINANCE N0.2011 - 121 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO ATWO-YEAR AGREEMENT WITH BOB'S ICE CREAM, INC., DBA QUALITY QUICK SNACKS, PROVIDING FOR VENDING SERVICES AT THE NORTH OLMSTED RECREATION CENTER. WHEREAS, acting pursuant to the provisions of Section 111.01 of the North Olmsted Codified Ordinances, the Recreation Commissioner solicited proposals for a revenue generating contract for the purpose of providing vending machine services at the North Olmsted Recreation Center; and WHEREAS, the Administration is satisfied with the quality of the services that have been provided to the North Olmsted Recreation Center by Quality Quick Snacks since 2004 and, following evaluation of their sole proposal under Section 111.01, the Board of Control recommends another extension of the two-year Agreement; and WHEREAS, this Council has previously adopted Ordinance Nos. 2004-7, 2005- 150, and 2008-8, and 2010-5, authorizing the Mayor to enter into Agreements with Bob's Ice Cream, Inc., dba Quality Quick Snacks [hereinafter, "Quality Quick Snacks"], for the purpose of providing vending and video game machine services at the North Olmsted Recreation Center for consecutive two year periods; and WHEREAS, it is the desire of this Council, based upon the recommendation of the Board of Control dated November 8, 2011, to enter an Agreement with Quality Quick Snacks for an additional two-year period from January 26, 2012, through January 25, 2014 calling for it to provide vending machine services only; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into atwo- year Agreement with Bob's Ice Cream, Inc., d.b.a. Quality Quick Snacks, for the purpose of providing vending machine services at the North Olmsted Recreation Center, for a term of January 26, 2012 through January 25, 2014, in substantially the same form and substance as the attached Agreement form. SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law.
