AGREEMENT between CITY OF NORTH OLMSTED, OHIO a n d QUALITY QUICK SNACKS f o r VENDING MACHINES FOR THE NORTH OLMSTED RECREATION CENTER THIS AGREEMENT made at North Olmsted, Ohio, on the 6th day of December, 2011, by and between the City of NORTH OLMSTED, 5200 Dover Center Road, North Olmsted, Ohio 44070 [hereinafter referred to as "CITY"], and BOB'S ICE CREAM, INC., d.b.a. QUALITY QUICK SNACKS [hereinafter referred to as "CONTRACTOR"]; WHEREAS, in pursuant to Section 111.01 of the North Olmsted Codified Ordinances a request for proposals was prepared and advertised in accordance with law for vending machine products and SERVICES for the North Olmsted Recreation Center under the direction of the Mayors Office of the City of North Olmsted; and WHEREAS, the CITY Council, at the request of the Administration and based upon the recommendation of the Board of Control dated November 8, 2011, pursuant to Ordinance No. 2011-121, has authorized atwo-year contract with CONTRACTOR to provide the SERVICES as set forth herein for the period January 24, 2012 through January 23, 2014 (fifth term); NOW THEREFORE, the CITY and CONTRACTOR, each acknowledging the sufficiency of the consideration contained in the terms and conditions of the Agreement, agree as follows: SECTION 1. BASIC SERVICES. 1.1 The SERVICES required to be performed by CONTRACTOR under this Agreement shall be the basic services as stated in bid specifications for bid proposal submitted on November 3, 2011, with such additional products and/or services as are specifically identified in Exhibit A, attached hereto and made a part here.
