CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 133 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE ONE (1) <br />NEW 2012 INTERNATIONAL 7500, TOGETHER WITH RELATED <br />EQUIPMENT FOR USE IN THE DEPARTMENT OF PUBLIC SERVICE <br />THROUGH THE STATE PURCHASE PROGRAM; FURTHER <br />AUTHORIZING THE MAYOR TO EXECUTE NECESSARY CONTRACT <br />DOCUMENTS; AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the City of North Olmsted acquire a new <br />International Base Chassis, Model 7500 SFA 6x4, at a cost of $96,781.00, together with bracing, <br />hinges and pins, tailgate latching system and hauling box at an additional cost of $68,883.43 <br />(total $165,664.43) for use at the Waste Water Treatment Plant for hauling sludge; and <br />WHEREAS, this unit will replace an aged unit which is beyond its useful life; and <br />WHEREAS, Council has, by separate legislation, addressed the necessary appropriations <br />for this purchase, which is exempt from public bidding through the State Purchasing Program; <br />and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the subject <br />truck, as a permitted exception to the competitive bidding procedure that otherwise would be <br />required for such expenditure, and to further authorize the Mayor to execute any necessary <br />contract documents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />State Purchasing Program, which was established by O.R.C. Section 125.04 and which the City <br />is authorized to participate in pursuant to Charter, one (1) new 2012 International 7500, together <br />with related equipment as described in the specifications on file in the Department of Public <br />Service. If necessary to effectuate any such purchase through the State Purchasing Program, the <br />Mayor is further authorized to execute any contract and/or other appropriate documents required <br />by the authorized vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor <br />shall be in a form and substance consistent with the provisions of this Ordinance and approved <br />by the Director of Law. <br />SECTION 2: 'T'hat this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />
