CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 134 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO RENEW THE <br />CONTRACT BETWEEN THE CITY AND KARRIE SKALL TIPTON FOR <br />THE PROVISION OF PROFESSIONAL GYMNASTICS INSTRUCTION <br />SERVICES AT THE NORTH OLMSTED RECREATION CENTER FOR AN <br />ADDITIONAL TWO (2) YEARS. <br />WHEREAS, Karrie Skall Tipton has, pursuant to a series of contracts authorized by this <br />Council, provided gymnastics program services at the City's Recreation Center since 1999; and <br />WHEREAS, it is the recommendation of the Mayor that the current contract between the <br />City and Ms. Tipton be renewed for an additional two-year term, for the period September 1, <br />2011, through August 31, 2013; and <br />WHEREAS, it is the desire of this Council to dispense with initiating an RFP or RFQ <br />process for said services and to approve and authorize the renewal contract with Ms. Tipton in <br />substantially the form as attached hereto, to provide for the contract to be effective as of <br />September 1, 2011, and to authorize the Mayor to execute said contract; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to execute a renewal <br />contract with Karrie Skall Tipton in substantially the form and substance as evidenced in the <br />Agreement for Gymnastic Instruction Services, attached to this Ordinance as "Exhibit A," with <br />only such changes to said contract to be hereinafter made as are not substantially adverse to the <br />City and which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution of the <br />agreements by the Mayor and the approval of the agreements by the Director of Law. Said <br />Contract shall be for atwo-year term effective September 1, 2011 and, unless further renewed, <br />concluding on August 31, 2013. <br />SECTION 2: That this Ordinance shall take and be in force and effect from and after the <br />earliest period provided for by law. <br />
