CITY OF NORTH OLMSTED ORDINANCE N0.2011 - 138 BY: Mayor Kennedy and Council Member Barker AN ORDINANCE AMENDING ADMINISTRATIVE CODE SECTION 131.01 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED TO PROVIDE AUTHORIZATION FOR THE MAYOR TO SIGN AND FILE GRANT APPLICATION FORMS TO OBTAIN SUPPLEMENTAL REVENUE OR OTHER TANGILBLE RESOURCES FOR THE BENEFIT OF THE CITY OF NORTH OLMSTED, EXCEPTING HOWEVER GRANTS WHEREIN CITYMATCHING FUNDS EXCEED EXPENDITURE LIMITATION. WHEREAS, the Director of Law has proposed amendment of Section 131.01 in order to eliminate the requirement that each and every grant application receive Council approval prior to submission, except in those cases where the city is obligated to provide matching funds or otherwise incur duties in excess of the limitation upon expenditures by the Mayor's office, currently established at $5,000.00; and WHEREAS, it is the desire of this Council to amend Administrative Code Section 131.01(b) of the Codified Ordinances of the City of North Olmsted to provide for and expedite administrative applications to obtain grant funding in the financial interest of the City of North Olmsted and the general welfare of resident; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 131.01, which currently reads as follows: 131.01 MAYOR' S CONTRACT AUTHORITY. (a) The Mayor may execute any contract to which the City is a party without obtaining authorization of Council if all of the following conditions exist: (1) The contract does not involve an expenditure of City funds in excess of five thousand dollars; (2) The Director of Finance certifies, if an expenditure of funds is involved, that, pursuant to Ohio R.C. 5705.41, sufficient funds have been lawfully appropriated and are available for such expenditure; and (3) The Mayor requests and obtains a written opinion from the Director of Law that the contract is in proper form and substance. (b) The Mayor, subject to review and approval by the Directors of Finance and Law, may also execute credit applications and enter into credit contracts with City vendors approved through either the City purchase order process or the City contracting process. (c) If any of the conditions set forth in paragraphs (a) or (b) above are not met with respect to any contract to which the City is a party, then the Mayor shall, prior to executing any such contract, obtain express authorization from the City Council.
