TEMPORARY EASEMENT
<br />RIGHT OF ENTRY FOR CONSTRUCTION
<br />MUNICIPAL PUBLIC IMPRUVEIIENT PROJECT
<br />I, Patricia Wilson, herein Grantor herein, for valuabie consideration received and to be
<br />received to my full satisfaction, do hereby grant and convey to the City of North Olmsted, a
<br />political subdivision of the State of Ohio, herein Grantee, a temporary easement and limited
<br />right-of-entry for the purposes hereinafter mentioned in the following described premises (the
<br />"Premises"):
<br />Situated in the City af North Oimsted, County of Cuyahoga, State of Ohio, known as being
<br />24116 Beech Lane, North Olmsted, OH 44070, Permanent Parcel No. 231-02-067, and bounded
<br />and described as follows:
<br />"A copy of the legal description is attached hereto as Exhibit "1 "
<br />consisting of Legal Description entitled Temporary Easement #1
<br />And which is made a part hereof as zf fully written herein.
<br />Grantor and Crrantee agree that all references to either party in this instrument shall include
<br />that pariy and the party's heirs, administrators, successors and/or assigns.
<br />In consideration of the mutual covenants contained herein, the Grantor hereby grants and
<br />V conveys to the Grantee, the limited right-of-entry and permission to enter upon the described
<br />premises for the purpases of preparing, staging, and otherwise performing the construction and
<br />installation of municipa.l public improvements on or witlvn public streets, rights of way, or
<br />within other pubfic property, as may be described by separate permanent easements conveyed to
<br />Gran.tee. This teznporary right of entry permits consfruction activities, including the occupafiion
<br />of workers, as well as placement of ma.terials, supplies and other construction equipment, may be
<br />necessary for the improvement project. Grantor pernuts the Grantee, its agents and employs, as
<br />well as service contractors #hereof, to enter upon arxd use the described premises, including but
<br />not lixnited to the trenclung, digging and d.isruption of ground surface, lawn and landscape
<br />materials, as reasonabie and necessary to construct public improvements.
<br />Grantea s}iall give Grantor reasonable notice, wz.der the circumstances, of the
<br />comm.encement of construction activitzes and exercise of f.his temporary easement and right of
<br />entry fox construction. The improvemettt project is scheduled to commence during the winter
<br />season of 2412 and the construction activity within the premises is estimated to proceed for
<br />approximately 60 days. Grantee may experience consfructian delays that extend the project
<br />beyond #he schedule outlined and the Grantor's pernvssion is and shall be extended, as is
<br />reasonable and necessary under the circwnstance. In the absence of an emergency, a11
<br />construction, inspection, repair, operation, maintenance, or surveying sha11 be performed only
<br />during hours from $ a.m. until6 p.m. on weekdays. Crrantor sha11 have and maintain, throughout
<br />the construction of improvements, full and complete access to the described premises, subject to
<br />Grantee's reasonable direction regarding safety and protection of construction equipnnent,
<br />persons, ar the generaJ public.
