SECTION 3: That the Mayor is hereby authorized and directed to compensate for and <br />accept, on behalf of the City of North Olmsted, a Permanent Easement from Patrick and Cindy <br />Moran, the owners of Parcel 235-12-039 at 5566 Burns Road, as further described within said <br />document, marked as Exhibit C, attached hereto and incorporated herein by reference. <br />SECTION 4: That the Mayor is hereby authorized and directed to compensate for and <br />accept, on behalf of the City of North Olmsted, a Permanent Easement from Center Properties <br />Ltd., LLC, the owner of Parcel 235-12-040, as further described within said document, marked as <br />Exhibit D attached hereto and incorporated herein by reference. <br />SECTION 5: That the Engineer of the City of North Olmsted is hereby directed to cause <br />said easements to be recorded in the Office of the Cuyahoga County Recorder. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to obtain said temporary easement in conjunction <br />with public improvement project ready to be commenced on the property, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shail take effect and be <br />in force immediately upon its passage. <br />PASSED: AX ?, 1 - <br />First Reading: ??I? l <br />Second Reading: ? <br />Third Reading: <br />ATTES : <br />? <br />1 <br />MAR E GALLO <br />Clerk of Council <br />APPROVED: YlCl u ,lt`,J... <br />YOR KEVIN M.
