1363.08 BUILDING CODE 112 401? <br />1.000 <br />Upon its review of the matter when requested, the Planning and Design Commission shall <br />determine the type and height of the new fence to be constructed along the boundary between <br />the commercial property and adjoining residential properties by applying the impact standards <br />set forth in Chapter 1126 of the Zoning Code. The commercial property owner shall replace <br />said fence, or portion of fence, within thirty (30) days of the order of the Building <br />Cornmissioner, or ruling of the Planning and Design Commission, whichever is applicable. <br />All surfaces shall be maintained free of broken windows, crumbling stone or brick, peeling <br />paint or other condition reflective of deterioration or inadequate maintenance to the end that the <br />property itself may be preserved, safety and fire hazards eliminated and adjoining properties <br />and the immediate neighborhood protected from blighting influence. <br />(d) Reconstruction of Walls and Sidings. All reconstruction of walls and sidings <br />shall be of siandard quality permitted by the Building Code, and their appearance <br />commensurate with the character of the properties in the same block and on both sides of the <br />street on which the premises front, such that the materials used will not be of a kind that by <br />their appearance under prevailing appraisal practices and standards will depreciate the value of <br />neighboring and adjoining premises as aforesaid. <br />(e) Freedom from Infestation. All exterior parts of premises shall be maintained so <br />as to prevent infestation of insects and rodents. <br />(Ord. 2010-1.1. Passed 2-16-10.) <br />1363.08 ADMINISTRATION. <br />(a) Building Commissioner to be Propertv Maintenance Officer. The Building <br />Commissioner is hereby designated to serve as the Properry Maintenance Off'icer hereunder, . <br />and all inspections, regulations, enforcement and hearings on violations of the provisions of <br />this Code, unless expressly stated to the contrary, shall be under his direction and supervision. <br />(b) Inspections. The Property Maintenance Officer may, upon receiving express <br />consent from. the owner or occupant, enter upon the premises, buildings or any accessory <br />structure in the Ciry to perform inspections or any other duty imposed by this Chapter. <br />(1) When an owner or occupant denies the Property Maintenance Officer <br />entry for the purpose of making an inspection or performing any other <br />duty, the Property Maintenance Officer may, upon affidavit, apply to the <br />Rocky River Municipal Court for a search warrant setting forth factually <br />the actual conditions and circumstances that provide a reasonable basis <br />for believing that a nuisance or violation of this Code exists on the <br />premises. <br />(2) Nothing contained in this section shall limit the right of immediate entry <br />by the Property Maintenance Officer onto any property in the Ciry when <br />the Property Maintenance Officer determines that a genuine emergency <br />exists threatening the immediate life, health or safety of persons exists. <br />(c) Conduct of Inspectors. Inspectors shall conduct themselves so as to avoid <br />intentional embarrassment or inconvenience to occupants. <br />(d) Procedure Where Violations Discovered. <br />(1) Notice to correct. Where a violation of any provision of this Code, other <br />than a violation of 1363.07(b)(1)(C), 1363.07(b)(1)(D), 1363.07(b)(1)(F) <br />and 1363.07(b)(2)(A)(1), is found to exist, a written notice from the <br />Property Maintenance Officer shall be served on the person or persons <br />responsible for the correction thereof. <br />2010 Replacement
