115 Real Propertv Maintenance Code 1363.99 <br />(b) Annual Review of Code Provisions and Operations. The Property Maintenance <br />Officer shall, in the month of January of each year, review with the Fire Chief, the City <br />Engineer, and the Director of Law the procedure and operation of this Code, and report to <br />Council on or before March 15: <br />(1) Any recommended amendment, addition or modification of a provision <br />of this Code consonant with the field experience of the personnel charged <br />with enforcement; <br />(2) A summary of the time sequence enforcement experience indicating the <br />number of violations abated, the number of cases processed in the <br />Municipal Court, the number of inspections made and such other and <br />further pertinent information as will provide Council with an annual <br />account of progress in securing the standards required by this Code; and <br />(3) Any further recommendation as to how this Code and the procedures and <br />operations hereunder can be improved. <br />(Ord. 2008-44. Passed 5-20-08.) <br />1363.11 STATUS REPORTS FOR USE BY INTERESTED PARTIES. <br />(a) Application for Status Report. Where, in lieu of an inspection, an owner, <br />operator, occupant, lessee, bona fide prospective purchaser, mortgagee or bona fide <br />prospective occupant request a status report as to whether or not there are any known <br />violations presently pending on certain premises, upon payment of the fee prescribed herein <br />and the written request, a copy of any notice or order on any violation then pending shall be <br />sent to the applicant. <br />(b) Significance and Scope of Status Report. No status report under subsection (a) <br />hereof shall be construed as providing a defense against any violation of this Code or any other <br />ordinance of the City which may be discovered thereafter, whether or not the condition or <br />violation existed at the time of any such status report. The status report is provided as a <br />convenience to the public and shall not constiiute a limitation on the full enforcement of this <br />Code. The status report shall include only such matters as are embraced in this Code. <br />(c) Status Report Fee. The fee for any status report or copy thereof under <br />subsection (a) hereof shall be four dollars ($4.00). <br />(d) Liabilitv of City. Neither the City nor any of its agents shall be liable to any <br />owner or subsequent purchaser of real property for violations of this Code. <br />(Ord. 95-33. Passed 7-5-95.) <br />1363.99 PENALTY; EQUITABLE REMEDIES. <br />(a) Whoever fails to make the payment provided in Section 1363.07(f) due to a <br />violation of 1363.07(b)(1)(C), 1363.07(b)(1)(D), 1363.07(b)(1)(F) and 1363.07(b)(2)(A)(1) <br />shall be guilty of an unclassified misdemeanor. If the citation for such violations is not paid <br />within a seventy-two hour period as provided for pursuant to Section 1363.08(e), then the <br />Building Department shall issue at least one (1) written communication to the owner of the <br />property at the address shown in the office of the County Auditor and advise the owner of the <br />citation. Such written communication shall be forwarded by regular mail and shall further <br />advise that any unpaid citation will be forwarded to the Rocky River Municipal Court, by a <br />date specific, not less than ten (10) days from the date of such correspondence, for further <br />proceedings and prosecution of the violation, subject to the imposition of Court costs and a fine <br />not to exceed one hundred fifty dollars ($150.00). <br />2008 Replacement
