•CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 46 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PUBLIC SER VICE <br />TO SOLICIT BIDS FOR THE COLLECTION AND DISPOSAL OF SOLID <br />WASTE AND RECYCLABLE MATERIALS; AND FURTHER <br />AUTHORIZING THE MAYOR, UPON APPROVAL OF THE BOARD OF <br />CONTROL, TO ENTER INTO A CONTRACT WITH THE LOWEST AND <br />BEST BIDDER, AND DECLARING AN EMERGENCY. <br />WHEREAS, the current term of the City's contract with Allied Waste for the collection <br />and disposal of solid waste and recyclable materials expires on December 31, 2012; and <br />WHEREAS, all contr.act extensions have been granted pursuant to the terms of the <br />contract; and <br />WHEREAS, it is the recommendation of the Director of Public Service that the City <br />advertise for bids for a new contract for the collection of trash and recyclable materials effective <br />January l, 2013, in accordance with the specifications on file in his office; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Director of <br />Public Service to solicit bids for the collection and disposal of solid waste and recyclable <br />materials in accardance with the specifications on file in his office, and to further authorize the <br />Mayor, following approval of the Board of Control, to enter into a contract with the lowest and <br />best bidder. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />advertise for bids for the award of a contract to provide for the collection and disposal of solid <br />waste and recyclable materials, as detailed in the specifications now on file in the Service <br />Department, and that further, the Mayor, following approval by the Board of Conirol is hereby <br />authorized to execute a contract on behalf of the City with the lowest and best bidder. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately given the <br />necessity to have in place a contract to accommodate trash pick-up, including the placement of <br />containers to accommodate automated trash removal (if necessary) not later than January 1, <br />2013; and further provided it receives the affirmative vote of two-thirds of all members of
